This reported behavior starts in 0.112u3. Prior to that the band of area at the top of the screen was still there - just a black background instead (attached) and the background was more of a gray color otherwise.

Change related to this, perhaps:
"Connected brightness support on the CPS1 board (not just CPS2) after
verifying that the real board does support it. [MAME Italia forum]"

Question is.. can we PCB verify that this reported bug is correct?

A test of the PCB is absolutely needed.
The game is definitely not placing opaquea characters on the top part of the screen, while it does put them in the rest of the screen. The palette is changed by setting the "brightness" part to 0, however it has been verified with tests on other PCBs that such setting doesn't correspond to a black color, but rather to just a darker color (50% in current MAME).

Therefore the background should definitely show on the PCB, though possibly at a different brightness than what MAME shows currently.

It looks like that on the PCB so it's correct :-)
